Landowner Deposits made under section 15A(1) of the Commons Act 2006 and section 31(6) of the Highways Act 1980

Guidance

The introduction of the Growth and Infrastructure Act 2013 amended the Commons Act 2006 with respect to the registration of Village Greens. The 2013 Act inserted secton 15A into the 2006 Act allowing landowners to bring to an end any period of recreational use 'as of right' over their land and also inserted section 15B into the 2006 Act introducing a Register in which such deposits are recorded. The 2013 Act also amended the procedure of deposits made under section 31(6) of the Highways Act 1980 in order for landowners to use the same procedures to deposit Landowner Statements, Highways Statements and Highways Declarations. The Regulations prescribing the rules for the aforementioned applications came into force on 01 October 2013.

How to make an application and deposit

Applications should be sent with cheques made payable to 'Essex County Council' to the following address:

If your application includes a deposit made under Section 15A(1) Commons Act 2006 (Landowner Statement), regulations require that notice of the application be posted for not less than 60 days at, or near at least one obvious place of entry to which the application relates. Should you wish the Council to undertake the posting of the notices please advise us within your covering letter and provide a marked plan and description of the most appropriate locations.
